What he's taking is their property and giving it to third parties without the property owners' consent. That's what copyright is for: to keep someone from taking your printed property and distributing it without your consent. As for him doing time, I think it depends on the severity of the crime and the persistence with which he has infringed the copyright.
Let us analyze the situation through a parable. Let's say that you're on the freeway doing 95 miles an hour when a highway patrol officer detects you in his radar. Now let's pretend that you've never been pulled over before, and that your wife had just called you and told you she was going into labor. When you explain your situation to the officer, and he sees that your record is clean, he might take pity to your plight and offer you an escort to where your wife is so you can pick her up. He might not, though, and instead choose to just let you off with a warning.

Now, let's say that after the officer lets you off with a warning, you drive off and flip the officer the bird as you drive away. You get home, pissed at the fact that that cocksucker pig pulled you over because you were going as fast as you wanted to go, and you get in your other car. You get on the freeway and proceed to drive 95 again. Once again, you get pulled over, by the same officer. This time your sob story isn't gonna hold because you just used it, so he writes you a ticket.

Fuming, you speed off, determined to get a CB radio so you can tell all your buddies on the road (let's assume that your buddies have CB radios in their cars) about that cocksucker cop that's pulled you over twice for speeding. You tell them that you're unsure what to do because you don't know how far the cop is willing to go. They reply with a mixture of responses that go from sympathy to scolding to encouragement. However, you only listen to those that encourage you to keep speeding because you don't think that the highway patrol officer is gonna spend energy and resources to catch you again, and even go as far as mocking the people who warned yo0u not to speed anymore. You boast over the CB that you're just gonna keep speeding to your heart's content, and that the police can go fuck themselves. Right after you say this, though, the CB crackles back to life and the highway patrol officer tells you that you're pretty much screwed because he heard your conversation, and has it recorded in his dashboard cam/recorder.
The next step is for Officer BangBros to get a warrant for the arrest of motorist Friday.
