To be fair, the details of the news story in the OP are VERY limited.
You guys are assuming she started sucking his cock, then he later claimed abuse because he didn't specifically give her verbal consent.
I *assumed* (perhaps wrongly, although any assumption could be wrong or right, considering the limited details) that this could have meant she began to perform the act on him while the man slept. This was my assumption, since I don't think it would be fair to claim sexual misconduct if he just sat there & let it happen. Though breaking in was still a crime in & of itself.
