why is porn legal when Prostitution isnt?

It's a perception deal.

Porn takes place in private and there are restrictions on how and when it can be displayed and advertised.

Prostitution (or at least the prostitution that most laws are aimed at) takes place in public and offends they eyes of righteous folk.

There's also a deeper issue over controlling women's bodies and what they do with them that is still, unfortunately, deeply ingrained in most societies.

Exactly. The Religious Right, has a harder time of shutting down porn, because it's so wide spread. Prostitution tends to pop up in small clustered places, where it can be, in essence captured. And Police go after Prostitutes rather than drug dealers standing on the same corner, because, they don't run, they don't put up a fight, they're less likely to carry guns and at the officer. Essentially they go for the easy bust.

How many times has cities attempted to legalize prostitution, with strict medical guidelines, permits. That means money for the city. Who steps in and votes it down? Churchies and Bible Thumpers. You'd be surprised how many prostitutes work out of Salt Lake, the heart of Mormon land.

Porn isn't (universally) legal in the U.S. People have the misconception that it is, just because we can sit in our living rooms and view it on a PC without getting a loud knock on the door from The Man. Obscenity laws are mostly based on the "prevailing community standards." So what might be legal in Las Vegas or Phoenix might not be legal where I live. Within the past couple of years, our local rag has run stories about people being charged with possession of obscene materials. One was a truck driver (passing through) who got pulled over for a DWI and the other was a local guy busted for drugs. Both had "obscene" DVD's and magazines in their possession. On the one busted for drugs, I asked a cop pal of mine if it was kiddie porn or animals or whatever. He said that it was just "normal" porn. But they decided to hit him with everything they could, since around here, what he had did (in their opinion) violate the local community standards. I didn't keep up with the case, so I don't know if he was convicted or not. A lot of the "Johnny come lately" Ronald Reagan worshippers on here (conveniently) forget how things played out during the Meese Commission days of the Reagan administration.

And the whole thing about the Max Hardcore/Paul Little case... the Feds cherry picked a locality to charge him in, otherwise he would have probably walked. CNBC did a special report on porn a year or so back, and it was the opinion of one of the Feds being interviewed that there is no such thing as "legal vs. illegal" porn. It's just that some of it will get you a charge quicker than others. There is SO much porn that they usually elect to just go after kiddie and REALLY extreme porn. But if an Ed Meese witch hunter type gets back in as AG, they could go after a lot more than that.

Scary stuff, eh? I was thinking awhile back when this topic came up, if Gisele, Jane B., Spexy, Chica or any of the other girls on here did their cam shows (even the tamest cam show) from where I live, they'd easily end up in jail as soon as the local yokels found out they were broadcasting from this county. And knowing this area (and those like it), the charges would probably stick.
 
its taxes man. pornography is a legimate business, like someone said above, there are guidelines. in the end, your business we can tax. Prostitution, well thats when american people pan out, in the words of the late george carlin, "we dont mind it, just not in my backyard." street prostitution is like thee wild west, its not regulated, just illegal. theres no money in it, well except for the pimp, but still. all the money you make you wont get back cause you didnt file taxes, your job is illegal so you cant. you want to be a professional prostitute, pay taxes, bills, own a house and a car maybe have fun for a few years, and actually retire with money you did put in the system, then do it right and go to porn valley.

Less than 1% of rapes result in conviction in England, if I remember the stats right. NO EXCUSE for that.

You get a paycheck when you work in Porn plus it's an industry and it's legal. Wheras prostitution is not. If you want to read more on the history of the porn industry i'd strongly advice you to read it on wiki.

Because porn is an expression... i.e. speech. I know alot of you guys don't actually care about the constitution except to abuse it so you get to keep your precious little life-threatening toys. But for those that have to abide by it - you know... courts, lawmakers and other such insignificant people - free speech is actually kind of a big thing.

Technically they are being paid for their time, not the sex act. Under California law, if person paying for the scene did not make physical contact with the performers then it was not considered prostitution. This varies state to state. Basically the court case involved in the pandering to prostitution bust opened the door for legal filming of pornography in California. It was a gray area before that.

Actually it's probably a lot more simple than we all think. Most porn companies pay TAXES.... Prostitutes don't. That essentially makes them the worst people on the planet, right? Worse than those people beating their children, that drunk driver who just killed that couple, or that rapists down the street. They, after all, pay their taxes.

Hmm, then why aren't the police arresting those church ministers, churches don't pay taxes right?

If prostitutes filed taxes as self-employed they would still be pinched. Remember 97 out of 100 prostitutes are not busted for tax evasion, they're busted for prostitution or something related to prostitution.

California state law had a gray area and that one particular case set the stage for legal porn production in the state of California. Prior to that, there were pornographers getting busted.
