Race, Power, and the Law

As people continue to get worked up about Obama's comments on the Henry Louis Gates story, I think it's important to remember what the president didn't say. He did not call the behavior of James Crowley, the arresting officer, racist. He did call Crowley's behavior stupid. And, really, I think it's hard to reach any other conclusion when you consider that Crowley arrested Gates after he realized Gates was "breaking in" to his own home. That's stupid--and Obama's right to say so. Even if Gates did act belligerently toward Crowley, you'd hope Crowley would be professional enough not to respond by slapping cuffs on Gates and taking him down to the station. The "contempt of cop" charge--which is what these disorderly conduct charges are often nicknamed--is really nothing more than an absue of power by the cop.

And, while I realize there are all sorts of issues of race tied up in the Gates case, I think that the power dynamics involved are getting short shrift. Even if you're white, any time you have an encounter with a police officer, the officer has the upper hand in terms of power, since he's the guy who has the power to arrest you. After that initial encounter, however, that power dynamic can be reversed--at least if you're sufficiently rich, accomplished, and connected, as Gates is. (If you're not those things, that power dynamic will probably never change.) Which is why, at this point, Gates clearly has the upper hand over Crowley in terms of power. The irony is that Crowley's initial abuse of power has now put him in the position of being largely powerless.

Of course, Crowley is going to have his defenders, who are now in the process of turning him into some sort of conservative hero. And when you read sympathic (non-ideological) profiles of Crowley like this one from the Globe, it is hard not to feel a little sorry for him. But that's when you need to remember that if Crowley had behaved differently at Gates's home--back when Crowley was the one with all the power--he wouldn't be in the situation he now finds himself in. And it does make you hope that, now that Gates clearly has the upper hand, the professor will behave differently--and more responsibly--than Crowley did. What's that line from Spider Man?

Did you just ignore the part where I said, "I'm not saying he should have been arrested."

And as many reports have stated, he did not immediately produce any ID. He initially refused and called the police racist. I don't think demanding ID from someone who is trying to jimmy a door open is all that unreasonable. I don't care if you're black, white, green, or orange, if you're involved in suspicious activity, you should be able to explain yourself. As I said before, if he cooperates, shows them a license, and exhibits a little courtesy, this wouldn't have even been a story. Not everything has to be about race. Christ, shit like this is tiring.

He asked for ID. That seems pretty procedural to me. The man was arrested after becoming confrontational. Are you going to defend the Professor's behavior? All he had to do was politely oblige and offer his driver's license to the officer. End of story as long as the addresses match. But no, that's just another way that the man is trying to hold him down...
 
This is not news... and it's not racism, whatever that is. It's cops being cops, and sometimes they are damned if they do, damned if they don't.

Let's get on with our lives and focus on real news events. :)

Because he knows that there is a golden opportunity to file a frivolous civil rights lawsuit if he baits the cop(s) just right. It pays to have friends at the top you know. In my estimation, these guys (Gates, with the assist of his friend and colleague obama) are gonna smear the shit out of this police dept. and ride off into the sunset 2 million wealthier !

IMO -Justice will not be served in this case because Barack Obama will not come out of this looking like a horses ass, no way - ain't gonna happen ! He's has too many people looking after him.

A dumb remark that I would think he probably regretted the minute he said it. Those of you who are just waiting for Obama to flash the fisted black power salute and show his true "colors" simply because he happens to be half-black are pissing upstream. There has been no overt action from him as president to indicate that he is a racist. Probably wishful thinking on your behalf, MP, because we all know that you despise the president so you will naturally let no opportunity pass to stoke those fires. Way too much ado about pretty much nothing in my opinion as it relates to this particular episode.

That said, I'm disappointed in the results of his presidency so far. What accomplishments of any substantive nature have been achieved by his administration at this juncture? (granted, it's still early but I have yet to see any sign of Obama being a dominant president who is capable of achieving the agenda on which he campaigned). Bear in mind that this is with an overwhelming majority in Congress and continued high approval ratings from the American public at large. He needs to be more aggressive and assertive in my opinion. I don't care what the detractors say, the American health care system is in a shambles and needs an overhaul. Those of you who would cry "socialism" and such are without credibility until you present a reasonable alternative that will address the incredibly huge issue that is before us.....millions of people without health care, millions more with lousy coverage and exorbitant premiums (like me) and a certain percentage of lucky fuckers snuggled in between with cushy policies that are, in most instances, GOVERNMENT subsidized. That has to change and it has to change with this administration.

Wasn't that what the press conference was all about to begin with? Instead, the spin doctors key in on a dumb statement that extremists would like to interpret as being blatantly racist against whites.

American government remains in gridlock. I'm at the point where I am willing to abandon all political biases in return for this whole rotten fucking system we have in place to be dismantled and begun anew. It doesn't seem to matter who the president is or which party happens to be in power....the process just doesn't work.

Its just that he shows his true colors more and more and I don't need to hear one more thing from him to know what he's about. I've heard enough.
I posted a thread here back in march 2007 regarding his church way before even fox news was on to it.
I've read parts of his autobiography which he makes his hatred towards whites obvious, I heard him call his grandmother a typical white women, I've seen the people he's been involved with.
I've read his wifes thesis,ect ect and now this.

I'm not an extremist, but he is.
And its not just this and from this president. Its alot of stuff over the last 15-20 years.
To me he just alligned himself right with Al Sharpton.
And, to me its scary that we have a PREz that thinks in that way.

I'm really disappointed that this administration feels the need to fast track something that everybody hasn't really taken the time to review first. I get the impression that they have something to hide, I mean, isn't it sensible to review the terms of a contract prior to committing ?
Could they just once stop fucking with our heads and create a nice tidy, easily understandable 25 page piece of legislation, less all of the semantics, legalese and earmarking ? Is that too much for a constituent to ask for ?

As it stands today, Obama hasn't given us the truth about our being able to keep our private med coverage. This health care bill is coercive to the private sector firms who pay for their employees insurance because an 8 % (IIRC) higher tax will be imposed upon them for employing a private sector plan. This, my friends is a soft tyranny because it encourages these private sector employers to cancel their relationship with their employees' medical insurer ..... right ?

IMO, The future of American health care is rationing, poor quality, poor care, 5o something year old folks that are turned away from receiving a simple routine bypass heart surgery because they're "Too Old" and they had a 15 year history of smoking cigs but successfully quit 2 years ago.

Just think if Steve Jobs was forced into a universal health care plan, he'd be very much a dead man today. Why would the government want to SAVE SOME WEALTHY GUY when that very government needs the revenue of said wealthy guy's estate ? Conflict of Interest ...Conflict of Interest ....Conflict of Interest ! We haven't even begun to discover the horrors that lurk before us in this universal plan of h/c.

The worst part of it is that obama is giving amnesty to God knows how many illegal aliens to hedge his bet on winning election '12. :mad:

I wasn't too familiar with this case until just the other day. Apparently it's a big deal, but they haven't really talked about it on the news here in Cleveland. Anyway, after doing a little bit of reading, I'm now well aware of what's going on. NOTHING. That's what's going on. Absolutely nothing. This is just another case of "white cop, black man" and nothing more than that. After reading articles from both sides of the story, I still can't find a valid reason as to why this is even news, other than the fact that Sgt. Crowley is white and Henry Louis Gates is black.

Do people in this country honestly think that situations like this never happen? Shit, I'm willing to bet that situations exactly like this happen every single day in cities all over the map. But, just because Henry Louis Gates happens to be friends with Barack Obama, we're supposed to think this is some sort of big deal? No, it's not. It's fucking stupid and people are just making a race-related mountain out of a fucking mole hill.

This is a comment that somebody made on CNN's website and I think it is dead on point...

So we all read the story, and then we fill in the background and the missing pieces based on our own experience and knowledge and beliefs about how things usually happen.

People are making hasty, uninformed judgments on this case by using their own experiences and beliefs as their motivation.

Excellent post. While I have issues with some of Obama's nominees and some of his proposals, there does seem to be a certain lunatic fringe like quality to the harpings of some of his critics. Some of Obama's followers I'm sure are similarly irrational in their support of Obama. But they don't seem to be nearly as vocal and quite frankly, not quite as delusional as some of the Nobama crowd.

What I find most unfortuntate about the fringe element Nobama crowd is that they hinder those who have legitimate questions and concerns about Obama or his policies. When I go to actual political forums and question an Obama policy, I find myself being surrounded by "helpful" Nobama types. And they jump on my bandwagon and begin howling about socialism, birth certificates, Islam, the end of times and what the Bible says. In their limited (mental) capacity, they believe that they are helping me. If I pose a question on the banking system, economics or the automotive industry, I generally don't need any help. In most cases, it seems that I have forgotten more than some of them will ever know about those topics. I'm just looking for views counter to my own, so that I might either debate them, or so that I might better understand the other side of the argument. These days I find that to be a complete waste of time, since I end up with the crowd that only knows the irrational, hyperbole that's been downloaded into their heads by Boss Limbaugh and the like.

This is a great porn board. So rather than continue to question how someone can be a (true) "fiscal conservative" and not know the first thing about supply side economics, or the fact that basic Keynesian policy is what has been used at the macro level in the U.S. since the 1930's (Reagan came close - but no cigar for him either, and no one before or since has even gotten their little toe wet in the water)... the shits & giggles threads on here seem to be the ones with the most validity.

Now, while some are barking at the moon here and waiting for Karl Marx to rise from the dead and take over America, or Obama's secret Praetorian Guard to attack middle America, I'm going to go see if LoveGisele has put up any more photos of her sliding her lovely, outrageous body across the hood of her Corvette.
