Highly doubtful they can kick him out of the home he's buying or purchased. He would just be court ordered to take it down by some date and if he didn't he'd face court sanction.

If you belong to a home owner's association (or a development), you can get kicked out for not following the rules and guidelines; rules and guidelines, by the way, that you have to agree to when you move into the development.

Like I said, it's most definitely a stupid thing to get all riled up about, but this guy didn't follow the guidelines that he agreed to. I did see in the OP that the request to remove the pole was lifted, but it still doesn't mean that there weren't rules to be followed.

Well, I'm sure the bank you financed your mortgage with would have something to say about that...as the HOA doesn't carry the mortgage. Who's going to pay the mortgage when the homeowner is forced to leave?

I'm fairly sure that the only remedy would be order to remove it or an injunction to cease some action.

Not at all, as a soldier follows orders from a superior officer, which does not include anyone on this insane HOA board.

Seems that there isn't any specific language in the HOA agreement forbidding flagpoles, but the HOA was refusing permission on esthetic grounds, ie, someone didn't like the visual of a flagpole on someone's property... short poles on houses are allowed, but the vet has his firm belief that not respecting the flag is offensive...and short poles are not made to raise and lower flags.
Either way, technically the HOA could have just as well have said OK on the pole issue, and Colonel Van Barfoot takes his past life and his present living habits quite seriously; he went ahead with the pole and the HOA is having a bitchfit over his not respecting their authority (anyone see an image of Cartman on his cop trike here?:D); get over yourselves, HOA pussies.
And the fact that they are now allowing it shows how arbitrary the ruling of denial was.
Reminds me of the movie Gran Torino...:thumbsup:

It may not sound PC and the only reason they dropped it is because it doesn't appear PC.

The association is well reasoned to have asked him (or anyone else service to the country notwithstanding) to remove a flag pole out of the middle of their lawn as the pole is the problem, not the flag.

It's a question of precedence in that community not patriotism.

Just because in his particular case he is a decorated vet, has a flag pole and (presumably) an Ensign to fly makes this sound particularly sympathetic.

But now since he can do this, why can't someone park flag covered or painted wreck on their lawn or someone else erect a flagpole in the middle of their law and fly a gay pride flag, Mexican flag, I hate America flag, confederate flag, etc.?

If such circumstances became the case it could erode the interests of property owners in that community...the very thing a HOA is in place to prevent. They exist to maintain some uniform standards within a community which protects the property interests of all there.

Presumably when you buy a place and want to do anything you want on your property don't buy into a community and sign contracts to abide by some HOA's rules. Buy acreage and a farm.:2 cents:

There have been several of these types of stories reported over the years and mega is correct, homeowners must follow a specific code or hoa guideline. Ask me all about the certified letters coming from ''my'' hoa board of directors, :1orglaugh the pricks !


If I was on the board of directors of this HOA, I'd go above and beyond to try to accommodate this decorated veteran instead of NO NO NO NO NO !:crash:

HENRICO COUNTY, Va. (WTVR) – Medal of Honor recipient Colonel Van T. Barfoot passed away Friday morning at the age of 92, according to his family.

Col. Barfoot was stepping outside of his Henrico County home on his way to visit his daughter early Tuesday afternoon when he fell and hit his head on the masonry walk beside his famous flagpole.

Godspeed, Colonel Barfoot. We hardly knew ye.
