There is no chance that that very poorly written, self contradicting and barely coherent diatribe was written by a journalist. It sounds more like an email chain forward than a piece composed by a pro. My verdict: epic fail, and no discrimination.

Technically, in the work place you are only mean't to speak one language infront of customers and fellow employees. If two Spanish people are speaking Spanish in front of a someone who doesn't speak that language, it is racial discrimination.
Technically? Source, please? And how is it racial discrimination to speak another language in front of a customer? Language is not a function of race. In common thinking there may connections drawn between certain ethnicities and certain languages, but in reality, every language is natively spoken by several different races. Are you perhaps intending to simply refer to company policies of McDonald's and it just came out wrong?
I think Mcdonalds is a franchise and each location have a different owner that sets the rules as they see fit.

You walk into a restaurant in America, and you order food in English, then behind the counter, the (for example) pakistani order taker starts talking in Urdu to other Pakistani workers. You probably don't know what the hell is being said, it could be anything. Maybe casual, or it could be personal about you. "Hey look at this idiot, what a shitty shirt he is wearing".
From experience in retail, restuarant or otherwise, this happens a hell of a lot more than You Might think. That is why I didn't bat an eye lid when I was told it was racial discrimination, it makes sense to me.

I hate when they have non english speakers at the drive thru. You have to say the order 5 times and they still get it wrong.
Almost no one but Aussies can speak Australian...it takes a lifetime to learn!If it makes you feel any better, I've had the same trouble with english speakers here.
