I don't know if this topic has come up or not but I'll ask about it.

I was just wtaching t.v. and saw some porn special on nbc. They had a part in there where they speak about Max Hardcore and how he has to serve 46 months for indecency and I think it was ten counts. Also they mentioned about how porn was illegal to produce and ship within the U.S. along with putting up websites.

If this is true, why is there so many porn sites up? I really don't know much about the porn industry so any feedback is appreciated.

It's illegal to have something obscene in an adult video.
 
Like Max or not, his trial and jailing are scary and bode ill for freedom in America. He was made an example of by political whacks with moral agendas, and convicted under laws which were so easily misconstrued that they could be used to convict anyone. Not good at all.

Oh well when life hands you lemons, you make lemonade or in Max case you make them gag till they puke and then piss on them.
 
The only controversy I ever heard about him that would get him under the government's microscope is in one of his videos a model, who was over 18, but in the film playfully said she was younger and that got him in some hot water for displaying a underage title.

Beyond that, if porn is illegal to produce and ship within North America, what do you mean? Wouldn't there be a lot of arrests made in California and Florida for the porn they produce alone? :dunno:

Well, not to nitpick, but Max's lemons chose to puke and be pissed on, and got paid for it. Hard to feel bad about that or convict the guy for it.

Don't forget the straw he'd put in their butts and make them drink the piss out of it that he just peed.

I honestly don't see the attraction, then again, with the amount of porn fetish and scenes out there, there are bound to people who enjoy his stuff.

That's right. I think there was something in there about "what was considered obscene or indecent to the mass of the public" . That is screwed up!

Yeah, it doesn't do anything for me either, and his stuff is actually on the short list of porn I've actually shut off and won't watch. But all the same, the participants were willing, of age and compensated, so it was their right to make that choice. Goes back to all those cliches that people throw around about liberty, like "Either we are all free, or none of us are."

Actually if you read the cases, the obscenity laws aren't all that subjective at times. Most of the major obscenity laws are spelled out pretty clearly by the judgments, which is where we get a lot of our laws.
 
I am reminded of Mobscene by Marilyn Manson for some reason when it comes to this thread. :dunno:

Hardly. In the U.S. obscenity is subject to the Miller Test, which is purposely vague and subjective, itself stating that whether something is obscene is subject to the views of "the average person" and what they would view as "prurient." Who is an "average person?" How could anyone say what this mythical "average person" would object to? Even if this person objected, who says that it's "prurient?"

It's all purposely vague and intended to allow different jurisdictions to decide for themselves what is acceptable and not in their locale, which sounds great at first, until one realizes that such vagueness opens wide the door to persecution and abuse. Obscenity charges have become like Nobel Prizes; getting one doesn't mean you deserve it.
 
I think there was something about him tricking some of his early models too. They didn't necessarily know what he was going to do :dunno:

I think our nation will still survive to see another sunrise if Max's shitty porn fades away into the ether....

Many, many valid points. In Max's case, I don't mind a subjective point of view because it was complete bullshit what he did to those girls. And after taking a long and distasteful tour through his preview section one day, I honestly don't believe that a lot of those girls knew what they were getting into. I see no one else getting hauled off or closed down so, for now, I'm willing to look the other way.
