at this point, I am rooting for this more than the scene itself... they deserve it
Nonsense. Nowhere in the sign-up details is it explicitly stated that they promise to provide a Madison anal scene within the timeframe of any member's membership, and when you are talking about the LEGALITY of these things, things have to be stated explicitly, or they don't hold up in court. Brazzers' lawyers would piss themselves laughing over a member or members threatening legal action over failure to provide a single scene of any nature.
Their promotion/advertisement was that Madison Ivy, as their first contract girl, was going to be featured in her first ever anal scene. Her contract, and time as a contract girl, is over on July 1, 2014. Therefore, if we are getting into technicalities and what will hold up in court, if the scene isn't available for members by July 1, 2014 this is false advertisement and should absolutely hold up in court.

No. Basic contract law. The terms and conditions that the members read and agree to (which say nothing about any particular performer or scene) before they sign up would be read aloud, the company can prove that they fulfilled their side of their contract, and the case would be dismissed in about two minutes. Technicalities is precisely why this lawsuit conversation is a load of rubbish ; there is no legal requirement of Brazzers as per their T&C to provide a Madi anal scene. People signed up and received what they paid for as per the T&C. Zero case to answer.
On a personal note, anyone signing up for a membership on the basis of ONE scene, before said scene has been filmed and published, is a dribbling idiot.
Agreed with you on the second part. I have never been a member of a porn site and never will be. So, I certainly wouldn't do it just for one scene.
While I understand your other points and thing it's a terrific argument, I still think there would be something that could be done for false advertisement, though. They advertised something and didn't deliver it. At that point it's not even so much about the members who paid as it is just a case of false advertising to anyone and every one.
Brazzers should not have advertised the scene until it was shot. And they didn't just do it once, they did it a few times. Heck, does anyone know if it has been shot at this point?
