Texas Accidentally Bans All Marriage

Texas lawmakers wanted to make sure gay people couldn't get married. Instead, it seems, they may have made sure no one can.

The Fort Worth Star-Telegram has the story. Here's what happened: In 2005, Texas voters and the state Legislature approved a Constitutional amendment to ban gay marriage.

But the amendment included the following clause, which was reportedly designed to ban civil unions and domestic partnerships: "This state or a political subdivision of this state may not create or recognize any legal status identical or similar to marriage."

Emphasis mine.

Any Texans out there? This is your lucky day. :1orglaugh

It's sickening how the majority is allowed to vote on the rights of a minority, especially when affording such equality doesn't not infringe with their rights at all.

:sing: Deep in the heart of Texas :sing:

This is a perfect example of why shifting political power to States (instead of a Federal govt) is a really bad idea. States do really dumb things.

Would have been funnier if it had been Arkansas.

Most people are sheep. They blindly follow the leader without thinking and want to destroy/ridicule/marginalize everything they don't understand. Despite all of the technological progress mankind has made most humans are still primitive beings.
A majority voting on the civil rights of a minority is a good example of how far modern society has really come since the dark ages.....not that far.

What's sad is that most Texans are actually proud from the fact they are from Texas. :1orglaugh It's like they don't realize that most of the rest of the country sees it as joke.

haha that's pretty good

That couldn't have lasted long in the Texas Code of Law book

Sometimes, people are really bad at wording laws, and other times, the editor doesn't notice things...

I don't see why gay marriage is a big deal. Is it really that bad that two people of the same sex get married? I kind of understand where people are going where they bring up references to the bible, but that was written a very long time ago. Should it really continue to apply to what's going on today?

All the argument really shouldn't exist. I truly believe that all men are created equal. If couples of opposite sex can get married, then so should couple of the same sex.

I agree that humanity has a long way to go & I agree that if the wishes of the minority don't hurt the majority, there's no harm in granting them their wishes (a few examples are abortion & gay marriage).

Still, we should be careful though... In Iraq, for instance, the wishes of the minority were granted even though they sometimes harmed the majority & I don't think this would be a healthy situation. But I assume that's not what you meant (an example closer to home would be to grant every wish of the reformed people in Zeeland or Friesland. Gay marriage would be banned, sex before marriage would be illegal, etc...).

If I hadn't been tipsy I'd probably be able to explain myself better, but this will have to do...

No the real question is "Why almost 150 years ago did the US go to war, to bring these idiots back into the Union?"

I think the key is 'as long as it does not infrige with other people' rights. Allowing gay and lesbians to marry only gives them equality under the law, str8 people will still still be able to marry other str8 people. I think what happens is that too many Texans would be too confused to know which sex to marry eventually.
