The United States Supreme Court will review the decision by the 9th U.S. Circuit Court of Appeals that struck down Proposition 8, a 2008 law which banned gay marriage in California.

The appeals court's ruling was issued in February and found the law unconstitutional.

The court will also hear a challenge to the Defense of Marriage Act.

According to SCOTUS Blog, the court is expected to hear arguments in late March and make a decision in late June.

WASHINGTON — The Supreme Court will take up California's ban on same-sex marriage, a case that could give the justices the chance to rule on whether gay Americans have the same constitutional right to marry as heterosexuals.

The justices said Monday they will review a federal appeals court ruling that struck down the state's gay marriage ban, though on narrow grounds. The San Francisco-based appeals court said the state could not take away the same-sex marriage right that had been granted by California's Supreme Court.

The court also will decide whether Congress can deprive legally married gay couples of federal benefits otherwise available to married people. A provision of the federal Defense of Marriage Act limits a range of health and pension benefits, as well as favorable tax treatment, to heterosexual couples.

An April Pew Research Center poll showed support for same-sex marriage at 48%, while opposition fell to 44%.[20]

A March 7–10 ABC News/Washington Post poll found 52% of adults thought it should be legal for same-sex couples to get married, while 42% disagreed and 5% were unsure.[21] A March survey by the Public Religion Research Institute found 52% of Americans supported allowing same-sex couples to marry, while 44% opposed.[22]

A February 29 - March 3 NBC News/Wall Street Journal poll found 49% of adults supported allowing same-sex couples to marry, while 40% opposed.[

When Barry gets his third SCOTUS installed my biggest concern is 2nd Amendment rights and what that will entail. This is such a non-issue yet you focus on it as if it would destroy us all??
If two people want to combine their household in a legally binding way its none of my business or yours. If the church doesn't like it then they don't have to have it in/or done by their churches it can be done at city hall. Why the people who scream less government want government intervention in this confounds me. Also the argument of the sanctity of marriage just doesn't hold water do you see what the divorce rate is in this country?? It seems to me a lark to give marriage any more credit than the folly it really is. Once again the right tends to allow itself to be distracted by issues that are truly just distractions from the real problems that plague us today. Try to focus on you and not your neighbors and you might live a happier existence.

However in California's case they legalized it, before Prop 8 prohibited it again, so at a minimum the SCOTUS will probably agree will the appeals court and reject Prop 8.

This is untrue Washington State for one has fully backed marriage for anyone.

I believe your much sought after civil war will more Lilkley come from a reaction to heavy handed federal agencies position on legalized marijuana. The people have voted and a clear choice had been made, the Feds should use their manpower and budgets rousting criminals not ordinary citizens. But we all know if marijuana is left alone they will eventually call for budget cuts for the FBI/ATF/DEA and we just can't have that now can we.
