Man sues police to get his porn back
Dennis Saunders, who recently completed a jail term for secretly videotaping a woman and a teenage girl in San Rafael, asked police to return the massive porn collection they had seized during the investigation. The collection, including some 500 movies and 250 magazines, was not relevant to the criminal case and is otherwise legal material, said Saunders' attorney, Jon Rankin of Tiburon. source: marinij.com

As long as it had nothing to do with the case and was legal material there is no reason they should keep his property IMO.

This happens all the time, the cops can keep it up until the trial is finished to complete the investigation. You wouldn't be happy!

Don't worry. He'll get most of it back, but some of the better parts of the collection will be missing.

Cops are human to. I personally would rather deprive the filthy kiddy voyeur of his porn and cut his balls off :rofl:, remember why he was locked up in th first place.
 
Well, when you seize things on a warrant, you will inevitably take more than the case requires. Once you've determined what's evidence and what's not, then you can contact the guy you took it from to let him know he can come get his stuff that's not being used against him.

And when you're dealing with a child porn case, you HAVE GOT TO look through all his porn to find out what's illegal and what's not. I can remember doing a warrant on one guy where my colleagues had taken all the regular porn, and I found just a spindle of unmarked CD-ROMs that had obviously been burnt on the computer. We took those, and low and behold! Naked little kids :throwup:

Before trial- he killed himself.
