The last two scenes I were at they just played the song over and over pretty much. Someone told me they had someone make songs for them to use. Not too sure of the status of the legal thing, but it seems kind of obvious to not use someone else's music without crediting them -- especially in porn.

Yeah, this is common. If plan to use someone's music in DVDs or whatever you need to pay for it. This is why for example sometimes when you watch a sporting event or something like the WWE on DVD you'll notice they change the entrance music to something generic because they don't want to pay the artist for having their song used on the DVD. The record companies ding you twice, once for the PPV and once for the DVD.

Filming in a public place while music is being played falls into the grey area of copyright holders.

There are many instances while filming in public that you will pick up background music.
