there were land deals with the cherokees before the indian removal act/trail of tears. in order to demonstrate 100% of cherokee land was wrongfully acquired by the U.S., you'd have to demonstrate all cherokee land before, during and after the removal act was not acquired legally/morally. same logic goes for any other tribe and whatever piece of legislation/treaty making is relevant to the particular geographical location.
