Help! The dudes from BANGBROS wanna sue me!

So I used to post free porno on another board and one of the dudes from Bangbros used to lurk there. I used to post a crapload of Bangbros porn and he got mad a while ago and told me to stop in a threatening manner. If he had asked me nicely then I might have stopped. But he came at me like he was some sort of hitman who was gonna break my legs. So I told him to fuckoff and he acted like a bitch by complaining to the board administrator. I got banned and he acted all high and mighty. So what did I do? I created my own messageboard where I post free porno, comics, music, movies, I showed it to him and now he's threatening to sue me.

My questions: Can he sue me? How could he get my info? If I ignored him would everything blow over? Do I take him seriously?

Please help.

Errrr. If you are posting copyrighted material, then he has every right to sue you because what you are doing is theft. And, yes, he probably can find out who you are if he is serious in doing so.

He's serious. Posting copyrighted material online is in violation of the Digital Millennium Copyright Act (DMCA). If you're posting their works and they ask you not to, you had better comply.

They're already on to you though. The best thing you can do is find a tall bridge and jump off. This is your only option...

Yes, they can sue you for breach of copyright, and if they go down the legal route they can subpoena whatever website you were posting on previously (if you aren't so forthcoming with this information) to give them your IP address in order to track you down.

They can get more than his IP address. A subpoena could get all of his billing information and contact info. Hosting illegal content is bad news, man. Bad news.

I have to agree, I'm studying law and all of the above is true, it's a breach of copyright, specifically the DMCA. The remedy for which would most likely be compensation for loss of earnings which would be tough to prove but better than jail time.

In this instance go out of your way to make the peace with them, try your best to meet any demands which are reasonable as if they accept any sort of goodwill on your part this would go in your favour if anymore came of it as it is part of acceptance on their part.

Take someone else's material from a pay site, post it for free, and what the hell do you expect? I mean, honestly? Did you think you were just providing a service to frugal porn lovers?

You were giving away material they copyrighted and not being cautious about it.

Take it down immediately. Tell them you've taken it down, and you'll never post it again. and MEAN it.

Your best bet is to shut down your site immediately and contact a lawyer. If you're really worried, it might not be a bad idea to talk to a lawyer before having any contact with them, including any letters of apology. He can tell you what to say and how to say it, so as not to get yourself into any more trouble. Once you put something in writing, you can't take it back. Good luck.
