Not sure that a class action lawsuit is possible given that the original in some way was posted on a public domain. Same reason why Facebook, Twitter, Instagram, Flicker, Google, etc. can host or sell your photos without your consent, and we all agree to that when we click that little "Do you agree to these terms" box.
