Cleveland Browns wide receiver Donte' Stallworth has been suspended without pay for the 2009 season for violating the NFL's personal conduct policy and its substance abuse policy, the league said Thursday.

Stallworth, 28, who pleaded guilty to DUI manslaughter in Florida in connection with a March 14 crash in which he struck and killed a pedestrian, will be reinstated after the Super Bowl in February 2010, the league said.

Florida unlike most jurisdictions, extends contributory negligence to cases which also involve DUI.

Stallworth's sentence reflects the feeling of the prosecutor that the actions of the deceased contributed more to the cause of his demise than the actions of Stallworth's. On that basis they made a deal fearing a conviction was unlikely based on their law respecting contributory negligence.

Investigations concluded Stallworth was not speeding or in breach of any other traffic law beyond having alcohol in his system and the deceased ran out in front of his car without looking.
