The chief prosecutor for the International Criminal Court has said there are 'serious suspicions' that the death of Libyan leader Muammar Gaddafi was a war crime.
Luis Moreno Ocampo said he sent a letter to the head of the National Transitional Council asking what the new government's plans are to investigate alleged war crimes by all parties, including the rebels.

The uprising against Gaddafi's 42-year rule erupted in February, quickly escalated into civil war, and ended in October with Gaddafi's capture and death in unclear circumstances.

Witness accounts and video taken of the deposed dictator after his capture by rebel fighters show that he was beaten and abused by his captors, and there were strong indications he was killed in custody.
Mr Moreno Ocampo said.: 'The death of Muammar Gaddafi is one of the issues to be clarified - what happened - because there are serious suspicions that it was a war crime.'

Well, one thing is sure in this story, I saw the pictures as well when he was captured and for sure he was alive at that stage. What happened then is humanity in it's most cruel form. Disgusting, and it never should have happened. However, understandable after all these years of repression.
But then again, the law is there and it remains a crime, not matter who we're talking about here.
Anyway, NATO helped the rebels and that also shouldn't have been happened. That fact, in my opinion, was a crime on it's own. I can't imagine people in my country going on the streets and have weapons like that within 24H. The Western countries didn't help rebels as such, these people on the streets were terrorists and not any better then Gaddafi. Just my two cents of course.

There are laws in place for a reason. Everyone deserves a fair trial.

I have to chime in here since this is an extremely rare example of an issue upon which I completely agree with Will E. He's right....what the vigilante crowd that captured him did was unquestionably a war crime. They acted in a manner that was consistent with what Gaddafi would have done under the same circumstances. Wrong is wrong regardless of the provocation.

It was a war crime, but regarding the whole situation, a minor one. Of course it will get a lot of attention because of the symbolic value of Gaddafis death. But its only one example of armed forces acting on lynchlaw.
Also Im sure quite some European politicians were happy that Gaddafi wasnt able to public some crucial informations about relations and trading with western countries.

Of course, what different countries, jurisdictions and belief systems consider a 'fair trial' is a massively movable feast.

If I were the soldier who'd popped a cap in Bin-Hidin's ass, I'd offer a defense that he was going for a weapon. In that paradigm, under most Western laws, the shooting by an agent of the state in that circumstance is universally considered justifiable. Also, it would be up to the court too prove otherwise - and given the only witnesses are unlikely to say anything different, this has all the smell and appearance of an utterly futile paper exercise.
